1. Agreement to Terms
Welcome to PawCheck ("Company", "we", "our", "us"). By accessing our website and using our AI-powered pet photo analysis tool, you agree to be bound by these Terms of Service and all applicable laws and regulations.
If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.
2. Service Description
PawCheck provides an AI-powered pet photo analysis tool that examines uploaded images of pets using pattern recognition. Our tool offers:
- Educational skin pattern screening for dogs and cats
- Educational eye pattern screening for dogs and cats
- AI pattern analysis with confidence ratings
- General educational guidance based on screening results
Important: PawCheck is NOT a substitute for professional veterinary care and does NOT provide medical diagnoses. Our AI screening is for informational and educational purposes only.
3. User Obligations
By using our service, you agree to:
- Provide accurate and complete information when creating an account
- Upload only images you own or have permission to use
- Upload only images of real pets (no inappropriate or offensive content)
- Not attempt to reverse engineer or abuse our AI models
- Not share your account credentials with others
- Consult a licensed veterinarian for actual medical advice
4. Payment and Billing
Pricing:
- Single photo analysis: One-time payment per analysis
- Monthly subscription: Unlimited photo analyses, billed monthly
- Yearly subscription: Unlimited photo analyses, billed annually
Billing Terms:
- All payments are processed securely through Payhip (via PayPal and major credit/debit cards)
- Subscription charges are automatic and recurring
- You can cancel your subscription at any time through your account settings
- Refunds are provided at our discretion on a case-by-case basis
- Single-use purchases are non-refundable once the analysis is completed
5. Cancellation and Refunds
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.
If you believe you were charged in error, please contact us within 14 days of the charge.
6. Medical Disclaimer
IMPORTANT: PawCheck is NOT a veterinary service, NOT a diagnostic tool, and does NOT provide medical advice or diagnoses.
Our AI analysis provides educational pattern recognition for informational purposes only. The results are not a veterinary diagnosis and should not be used as a substitute for professional veterinary examination, diagnosis, treatment, or advice. Always consult a qualified, licensed veterinarian with any questions you may have regarding your pet's health.
We do not guarantee the accuracy of our AI screening results. AI pattern recognition has inherent limitations and may contain errors or false positives/negatives.
7. Limitation of Liability
To the maximum extent permitted by law, PawCheck and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use or inability to use the service
- Any AI screening errors or inaccuracies
- Decisions made based on our service results
- Unauthorized access to your data
- Service interruptions or technical issues
TOTAL LIABILITY CAP
To the maximum extent permitted by law, in no event shall PawCheck's total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the service exceed the greater of (a) the total amount you paid PawCheck in the twelve (12) months preceding the claim, or (b) USD $100. This cap applies in the aggregate to all causes of action, whether in contract, tort, or otherwise.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
8. Mandatory Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
8.1 Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service ("Dispute") shall be resolved exclusively through binding individual arbitration, not in court. This includes disputes regarding:
- The accuracy, reliability, or outcome of any AI screening report
- Decisions made based on our service results
- Billing, refunds, subscription, or account issues
- Privacy or data-handling practices
8.2 Arbitration Process. Arbitration will be conducted by a single neutral arbitrator under the rules of the American Arbitration Association (AAA) or, at PawCheck's option, JAMS. The arbitration will take place remotely or in a mutually agreed location. Each party shall bear its own costs unless otherwise required by law.
8.3 Class Action Waiver. You and PawCheck agree to bring claims only in your or its individual capacity. You expressly waive any right to participate in any class action, collective action, mass action, consolidated action, or representative proceeding. The arbitrator may not consolidate the claims of multiple parties or preside over any form of representative or class proceeding.
8.4 Exceptions. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or to prevent unauthorized service access. Disputes that qualify for Small Claims Court are also excluded from mandatory arbitration.
8.5 30-Day Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to hello@pawcheck.online within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you are opting out of arbitration.
8.6 Severability. If any portion of this section is found unenforceable, the remainder of this section, and the remainder of these Terms, shall continue in full effect.
9. Data and Privacy
Your use of our service is also governed by our Privacy Policy. We collect and process your data as described in that policy.
By using our service, you grant us a license to process uploaded images for the purpose of AI analysis. We do not sell your data to third parties.
10. Intellectual Property
All content, features, and functionality of the PawCheck service, including but not limited to text, graphics, logos, and AI models, are the exclusive property of PawCheck and are protected by international copyright, trademark, and other intellectual property laws.
11. Termination
We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Continued use of the service after changes constitutes acceptance of the modified Terms.
